Fable UI Terms of Service
Effective date: 2026-11-01. Seller/operator: Fable UI, trading as Fable UI; required business contact/address Fable UI is operated by Higgins Digital, Charlotte, NC, USA. Support: info@higginsd.com. Legal: info@higginsd.com.
1. Scope and acceptance
These Terms govern the Fable UI website, orders and related services. Product use is governed by the separately linked License Agreement. Privacy practices are described in the Privacy Notice, which is a disclosure rather than blanket consent to optional processing. Before a purchase you must affirmatively agree to the Terms and License, receive the price/scope/delivery disclosures and be able to retain copies. Browsing alone does not evidence agreement to undisclosed purchase obligations.
2. Eligibility and purchasing authority
You must be at least 18 or have the legal capacity required for the purchase and, when acting for an entity, authority to bind it. Give accurate purchaser, licensee and contact information. The service is not directed to children under 13. Do not impersonate another party, use unauthorized payment details, bypass purchase controls or request access to orders that are not yours.
3. Products, prices and catalog descriptions
Individual Component $25 USD; Complete Library $250 USD; both one-time before applicable tax. Exact purchased Components/releases are listed in the order snapshot. Future additions/updates and recurring service are not included unless expressly stated in your order. Show and verify actual dependencies, included files, third-party requirements and tested compatibility before buying. Previews may demonstrate interactions and environments; included/excluded third-party assets are identified on the product page. Prices may change prospectively before a quote is accepted. The agreed order total and scope may not be materially changed after payment without a lawful remedy and your agreement where required. No misleading savings, fake scarcity or unsupported testimonials form part of this offering. Duplicate purchases or scope overlap will be flagged for review rather than intentionally double-charged.
4. Order process and payment
The checkout review shows products, included scope, USD subtotal, applicable tax or tax treatment, total, delivery timing and legal terms. Stripe processes payment using its hosted Checkout; Fable UI does not receive or store your complete card number. Order state depends on verified payment, not merely a success URL. A delayed or failed payment may remain pending and is not confirmed as paid until verified. You are charged only through a legitimate authorized payment flow. Applicable taxes are calculated and disclosed according to configured registrations and sales territory requirements. The business is responsible for its actual obligations; a payment platform does not itself establish compliance. Stripe and other processors have their own terms/privacy practices. A payment receipt does not grant rights outside the applicable License Agreement.
5. Digital fulfillment
After verified payment we send a confirmation. A separate email provides secure access when preparation of your purchased files is complete. The processing estimate displayed before payment is within 2 business days. Delivery is electronic; no physical shipment. Promptly contact support if confirmation or delivery is missing. We will investigate bounces, incorrect scope, corrupted packages or delays and provide appropriate remedies under the Refund & Delivery policy and law. Access may require email verification or sign-in. Security links may expire and be renewed through a reasonable identity-verification process. This expiration does not by itself terminate your license. Do not share credentials or access links. Fable UI will not require you to join a marketing list to receive a purchased product.
6. Accounts, recovery and acceptable use
Protect your credentials and promptly report suspected unauthorized access. We may use proportionate controls against fraud, abuse, account enumeration or security threats. Do not scrape private data, upload malicious files, interfere with availability, forge API/payment events or exploit access-control defects. Responsible vulnerability reports may be sent to info@higginsd.com. Access restrictions must be reasoned, proportionate and subject to applicable law; they are not automatic proof of wrongdoing or authority to seize unrelated customer information.
7. License, ownership and third-party material
Products are licensed, not sold as intellectual-property ownership. The License Agreement permits legitimate personal/commercial End Products and bounded client handoffs while restricting unauthorized standalone sharing, redistribution and resale of proprietary material. Original third-party licenses and mandatory rights are preserved. No term claims ownership over code merely because it was curated, purchased from another vendor or renamed. Fable UI trademarks and website content may not be used to falsely imply endorsement.
8. Refunds, problems and disputes about charges
The linked Refund & Delivery policy applies. We do not impose an absolute digital-goods no-refund rule that overrides mandatory rights. Contact support about duplicate charges, nondelivery, incorrect files or material defects. Lawful payment dispute rights remain intact; requesting help does not require waiving them. Approved refunds and charge outcomes are reconciled to the affected order lines and licensed scope. Do not submit knowingly false claims or fraudulent chargebacks; no fixed penalty is imposed by these Terms.
9. Service availability and support
We aim to provide a functional storefront and fulfillment service, but maintenance or provider outages may occur. We will communicate material delivery issues and provide required remedies. Product-specific technical support and compatibility commitments are only those actually advertised. No custom integration, ongoing development work, indefinite hosting/download availability or new releases are promised unless expressly agreed. The right to use lawfully delivered materials is distinct from indefinite hosting access and remains subject to the License.
10. Information accuracy, privacy and communications
Fable UI describes products based on what has been verified. Reasonable corrections to future catalog pages do not replace remedy obligations for a materially misdescribed purchased product. We send transactional messages needed to process and deliver orders, security and support. Optional marketing requires a separate lawful basis/choice and unsubscribe process. Data handling follows actual disclosed practices, not a claim that this document alone creates regulatory compliance.
11. Disclaimers, limits and remedies
The License's qualified warranty/liability provisions apply to Components. To the extent lawful, site services are provided without a guarantee of uninterrupted operation or fitness for every project; express commitments and non-excludable rights remain. Aggregate contractual liability for the affected purchase is limited to that order's paid amount, except fraud, intentional misconduct, gross negligence where non-excludable, privacy/security liabilities that cannot be limited, mandatory consumer rights and other legally protected liabilities. Nothing grants immunity from Fable UI's own unlawful conduct. For unauthorized proprietary-material distribution, available civil remedies may be pursued subject to proof, defenses and legal prerequisites. No automatic fine, penalty amount, guaranteed attorney-fee recovery or promise of criminal punishment is made. Only competent authorities determine public-law penalties.
12. Suspension and termination
The License specifies affected product-use termination. Site access may be temporarily restricted for legitimate security or fraud reasons with appropriate notice where lawful. For remediable material breach, ordinarily provide at least 14 days to cure, subject to law and serious ongoing infringement exceptions. Do not terminate unrelated independent licenses solely because one order is disputed. Preserve lawful records, appropriate customer access/remedies and privacy obligations.
13. Governing law and general provisions
Proposed governing law and venue are those in Section 16 of the License, subject to actual seller/legal approval and mandatory consumer/jurisdiction rights. No mandatory arbitration or class-action waiver is included. Invalid provisions are severable only as law permits; failure to enforce is not permanent waiver. Material Terms changes govern new transactions prospectively, not unilaterally rewritten historical purchases. Applicable law prevails; the License governs product use and the Order Snapshot governs purchased scope. Contact the verified seller above for questions or disputes.
